Welcome to helona, an AI-powered copilot designed to help property managers automate and streamline their operations. These Terms and Conditions ("Terms") govern your use of the helona software, available as both a web and mobile application, and provided by helona ("Company", "we", "us", or "our"). By accessing or using helona, you agree to be bound by these Terms.

2. User Accounts

2.1 User Types and Permissions

helona offers different types of user accounts, including property managers, landlords, tenants, resident advisors, and janitors. Each user type has different permissions and actions available within the application. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

2.2 Age Restrictions

There are no age restrictions for using helona. However, by using the application, you represent and warrant that you have the legal capacity to enter into these Terms.

3. Subscription Plans

3.1 Subscription Tiers

helona offers four subscription plans: Free, Novice, Pro, and Enterprise. Access to certain features and functionalities of the application depends on the subscription plan selected.

3.2 Payment Obligations

If you subscribe to a paid plan, you agree to pay all applicable fees associated with the plan. Failure to pay your subscription fees will result in the loss of access to the application. Access will be restored upon successful payment.

4. User Responsibilities

4.1 Compliance with Laws

Users must use helona in compliance with all applicable laws and regulations. Any use of the software with malicious intent, including but not limited to fraud, hacking, or illegal activities, is strictly prohibited and may result in immediate termination of your account.

4.2 Non-Payment

Users subscribed to a paid plan who fail to pay their subscription for three consecutive months will have their accounts terminated.

5. Third-Party Integrations

helona currently integrates with AWS for data storage and management. By using helona, you agree to comply with AWS's terms and conditions as they apply to your use of the service.

6. User-Generated Content

Users may upload content, including Excel file templates, and in the future, PDF documents and photos. All user-generated content must comply with our content guidelines and applicable laws. helona reserves the right to remove any content that violates these guidelines or laws.

7. Data Collection and Usage

helona collects certain personal information, including but not limited to your name, address, email, phone number, date of birth, and nationality. This data is used solely for providing and improving the helona service and will not be shared with third parties.

8. Liability Limitations

helona is provided on an "as-is" and "as-available" basis. We do not guarantee that the service will be uninterrupted, secure, or free from errors. We disclaim all responsibility for lost data, loss of profits, or any other damages arising from your use of helona.

9. Changes to the Terms

We reserve the right to modify these Terms at any time. Users will not be notified of changes unless they have specifically requested to be informed. If you request notification of changes, we will send updates to your registered email address.

10. Termination

We may terminate or suspend your account immediately, without prior notice, if you use the software with malicious intent or fail to pay your subscription for three consecutive months. Upon termination, your right to use helona will immediately cease.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of Luxembourg, without regard to its conflict of law provisions.

12. Dispute Resolution

Any disputes arising out of or in connection with these Terms will first be attempted to be resolved verbally. If a verbal resolution is not possible, all options, including arbitration or court litigation, are available for resolving the dispute.
